Court Reverses Itself: Homeschooling Constitutional

In a reversal of an earlier ruling, the California Court now says homeschooling is Constitutional.

the California Court of Appeal ruled that the state’s education code allows parents to home school their children. That decision means parents do not have to obtain state credentials in order to home school. The court acknowledged that a state prohibition on home schooling would intrude on parents’ constitutional right to direct their children’s education, and that that any limit on that right would be presumed unconstitutional.

This is a great ruling for homeschoolers. All parents though need to stay vigilant and watch who we elect to courts. A resource for learning about judges, besides news from Focus on the Family, is Judgepedia, a project of the Sam Adams Alliance.

Watching our judges is very important. There are many judges who are becoming activists and making legislation. This is not there role. They are only to make sure laws abide by the Constitution. Unfortunately today, legislators are allowing the courts to make rulings so they won’t be blamed and won’t to have go on record as opposing the will of the people.
