Is District Blog Rules Unconstitutional?

The Citizen Advocacy Center in Elmhurst believes the rules against blogging are and they will be presenting their case to the Libertyville-Vernon Hills District School Board on monday night.


          

The new Libertyville-Vernon Hills Area High School District 128 rules say students in extracurricular activities will face disciplinary action for maintaining or being identified on an Internet blog that depicts illegal or inappropriate behavior.

Terry Pastika, executive director of the Elmhurst-based Citizen Advocacy Center, said the policy is overreaching and, in parts, too broad.

“There’s no definition in the policy to define what ‘inappropriate’ means,” said Pastika, whose group consists of lawyers and volunteers who focus on civic issues.

Pastika also questioned whether any blog entries targeted by the policy would substantially disrupt school operations, a requirement established by a landmark U.S. Supreme Court case regarding student activity.

Representatives from the advocacy center will talk to district officials about the policy during this Monday’s school board meeting. The session is scheduled for 7 p.m. at Vernon Hills High, 145 Lakeview Parkway.

Additionally, an independent community discussion about the blogging rules is scheduled for 7 p.m. Friday at the Libertyville Township hall, 359 Merrill Court. Two interns for the advocacy center will lead the talk, but it is not a center event, Pastika said.
